Bellingham ZBA upholds Planning Board decision on conditions

Bellingham Zoning Board of Appeals upholds Planning Board decision on Prospect Village conditions. Louis Petrozzi, president of Wall Street Development Corp, appealed conditions imposed on a development plan approval for the Lake Street and Prospect Street project, arguing the Planning Board exceeded its authority under the zoning bylaws. Town Counsel opined the Planning Board does have authority to impose conditions and that reasonableness is a court matter.

The ZBA voted unanimously to uphold the Planning Board decision.
